SCOPE OF THIS NOTICE
Petoodle, LLC which provides the Petoodle Services (“Services”) respects your (“you”, “your”, “user”) privacy concerns. This privacy notice (“notice”) describes our policies and practices regarding your personal data (which some jurisdictions may refer to as “personal information”) and how we treat it. Before you use or submit any information through or in connection with the Petoodle Services (collectively “Petoodle”, “we”, “us”, “our”) you acknowledge the collection, use and disclosure, including third-parties acting on our behalf, of your information as outlined in this Notice.
I. PERSONAL DATA THAT WE COLLECT ABOUT YOU
This Notice covers both our online and offline data collection activities. When you use or otherwise access the Services, we collect information in multiple ways, including when you provide information directly to us, and when we passively collect information from your browser or device (e.g., by logging how you interact with our Services). We do not knowingly solicit or collect personal data from children below the age of 13. II. DIRECT COLLECTION DATA:
Information you choose to provide us.
Animal Welfare Organization data collection: When Animal Welfare Organizations (shelters, rescues, sanctuaries, advocacy groups, humane societies, etc.) create their organization’s profile page or post an animal on the Services, we collect the information you choose to provide us and we display it through our Services. All information used to create that account (email address, login/password (in unrecoverable form), zip code, country, phone number, screen name, and/or photos and social network details.) Should you choose to provide us with information relating to third-parties, you disclose the name or circumstances of that third-party. For example, any data that you share publicly on a third-party social network or data that is part of your profile on a third-party social network (such as Facebook) and that you allow the third-party social network to share with us. By providing information in your profile or a posting(s), you consent to our collection, storage and use of your data. If you upload personal data related to third-parties, you acknowledge and agree that you have the authority of the relevant third-parties for us to access and use the relevant data and that you have notified the third-parties and informed them of how their information is collected and used to provide the Services. We reserve the right to identify you as the person who has made the referral in any messages that are sent to them. Our payment processors collect and maintain your bank, credit card and any other information needed to facilitate the collection and withdrawal of funds from any postings.
- Sponsor/Donor information: In the Services, a Sponsor creates a recurring monthly donation; a donor creates a one-time donation. A user account can be one or both of these options. When a sponsor and/or donor create an account on the Services, we collect the information you choose to provide us and we display it through our Services. All information used to create that account (email address, login/password (in unrecoverable form), zip code, country, phone number, screen name, photos and social network details.) Should you choose to provide us with information relating to third-parties, you disclose the name or circumstances of that third-party. By providing information in your profile or a posting(s), you consent to our collection, storage and use of your data. If you upload personal data related to third-parties, you acknowledge and agree that you have the authority of the relevant third-parties for us to access and use the relevant data and that you have notified the third-parties and informed them of how their information is collected and used to provide the Services. We reserve the right to identify you as the person who has made the referral in any messages that are sent to them.
- Third-party Payment Processors: Petoodle utilizes third-party payment processors to facilitate transactions on the Services for both Animal Welfare Organizations and Sponsors/Donors. Animal Welfare Organizations who use the Services must create an account for their organization with our third-party processor directly and will be bound by the terms of service and privacy policy of that provider. Our payment processor collects and maintains information related to your account with them such as credit card information and address. III. PASSIVE DATA COLLECTION:
When you interact with the Services, certain information from devices that you use to access the Services is automatically received and stored. This information is collected passively by using various technologies. This includes data about the computer system or other technological device that you use to access one of our services, such as the Internet protocol (IP) address used to connect your computer or device to the Internet and other online identifiers. If you access the Services via a mobile device such as a smartphone, the collected data will also include, where permitted, your phone’s unique device ID, advertising ID, and other similar mobile device data.
- Cookies and Other Similar Technologies: We, and our service providers, use various technologies to collect and store information when you use our Services, and this may include sending 'cookies' to your device. Cookies are used to collect information about your access to and use of the Services. - Payment and Financial Data: It is not Petoodle’s policy to collect and/or store payment and financial data, such as debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if such are made available). Our third-party payment processing provider handle payment and financial data in a manner compliant with applicable laws, regulations, and security standards.
- Internet or Other Similar Network Activity: This data includes websites and communication usage data. As you navigate through and interact with our Services, we use automatic data collection technologies to collect certain data about your device(s) and your actions. This includes data such as which links you click on, which pages or content you view and for how long, and other similar data and statistics about your interactions, such as content response times, download errors, and length of visits to certain pages, as well as operating system type and web browser type and version. This data is captured using automated technologies such as cookies and web beacons and is also collected using third-party tracking for analytics and advertising purposes. We use this data for a number of purposes, such as personalization and other general business purposes, like internal or market research, analytics, and security.
- Third-Party Social Network Data: Any data that you share publicly on a third-party social network or data that is part of your profile on a third-party social network (such as Facebook™) and that you allow the third-party social network to share with us. Examples include your basic account data (e.g., name, email address, gender, current city, profile picture, user ID, list of friends, etc.) and any other additional data or activities that you permit the third-party social network to share. We receive your third-party social network profile data (or parts of it) every time you download or interact with a web application on a third-party social network, every time you use a social networking feature that is integrated within one of our sites, or every time you interact with us through a third-party social network. - Audio, Electronic, Visual, or Similar Information: This data may include photos and videos that you share with us as consumer-generated content or via third-party social networks, as described above, as well as recordings of and information you provide during your usage of the Services. We may also visually record your interactions with our website, including your mouse clicks, movement, scrolling, and navigation through our website.
- Inferences: We may draw inferences from the data we collect from and about you to create a profile reflecting your preferences, characteristics, and behavior. We use this data for personalization and other general business purposes, such as internal or market research, analytics, and security.
- Analytics software: When you use our Services, we and our service providers, such as social media widgets, website analytics, and online ad networks, may receive certain information from your use of our Services, including, but not limited to the web pages or sites that you visit just before or just after you use our Services, the dates and times that you use our Services, the actions you take on our Services and device information such as your IP address, operating system, locale, and web browser. We use third-party web analytics services on our Services, such as those of Google Analytics™, to help us analyze how users use the Services. Service providers such as analytics providers may collect information about your online activities over time and across different online services when you use our Services. This may result in you seeing advertisements for our Services when you visit other websites as well as placing interest-based advertisements on our website.
IV. HOW WE USE YOUR PERSONAL DATA
The following paragraphs describe the various purposes for which We collect and use your personal data, and the different types of personal data that are collected for each purpose. Please note that not all the uses below will be relevant to every individual. We will not sell, share, or trade our donor lists containing personal information, including names, email addresses, mailing addresses, and phone numbers, with any other non-affiliated organization, and non-participating non-profits for their purposes, unless donors have given us specific permission to do so.
- User service: We use the information we collect for user service and administrative purposes, including responding to your inquiries. This typically requires the use of certain personal contact data and information regarding the reason for your inquiry (e.g., sponsorship status, technical issue, product question/complaint, general question, etc.). We also use the information we collect to send you communications relating to the Services, such as updates on Services, communications relating to products and services offered by us and by third-parties, and communications about services we believe will be of interest to you. For example, we will send periodic emails to registered users of the Services relating to their recent interactions with the Services, such as donating to a posting.
- Marketing and other promotions: We may use your personal data to provide you with information about goods or services (e.g., marketing communications or campaigns or promotions). This can be done via email, ads, SMS, phone calls, and postal mailings to the extent permitted by applicable laws. Some of our campaigns and promotions are run on third-party websites and/or social networks. users through demographic, behavioral and contextual means. These networks track your online activities over time by collecting information through automated means, including the use of cookies, web beacons and other methods. The networks use this information to show you advertisements that are tailored to your interests. The information our ad network vendors collect include information about your visit to the Services as well as pages you have viewed, and the actions you have taken on the Services.
- Mobile Services: You agree that we can communicate with you regarding your account on our Services by SMS, MMS, text message if you access the Services through a mobile device and if you have chosen to provide us with your mobile number, or other electronic means to your mobile device.

- Security and Fraud Prevention: We use the information we collect to secure our Services and to verify identity, prevent fraud, and to continually improve these aspects of our Services.
- Analytics, Research and Product Development: In an effort to continually improve our user’s experience, we use the information we collect to analyze preferences and data usage trends in an effort to improve the security, usability, accuracy, effectiveness, or popularity of our Services.

- Third-party social networks: When you interact with third-party social networking features, such as “Like” functions, we use your personal data to serve you with advertisements and engage with you on third-party social networks. - Account Accuracy: We use personal data to account for donations and to inform you about the status of your donations (if any). Examples of other maintenance functions requiring the use of personal data are, updating account info, conducting identity verification and other fraud detection activities, conducting internal or market research, and measuring the effectiveness of advertising campaigns. We also use your personal data for management and operation of our communications, information technologies and security systems.
V. DISCLOSURE OF YOUR PERSONAL DATA
The following paragraphs describe how we disclose your data. There are certain circumstances in which we share information collected through the Services with certain third-parties without further notice to you, as set forth below.

- Legal Requirements: There may be instances when Petoodle is required to access, disclose and/or transfer your information when doing so is necessary to: (i) comply with the law and other legal process; (ii) respond to inquiries from government, regulatory, law enforcement, public authorities, or content protection organizations; (iii) protect and defend the legal rights, privacy, safety or property of Petoodle, its affiliates, subsidiaries, employees, agents, contractors, or its users; (iv) permit us to pursue available remedies, commence, participate in, or defend litigation, or limit the damages we may sustain; or (v) enforce this Notice or any applicable Terms of Service.
- Other Users of Our Services: If you choose to make your information publicly available in a publicly accessible area of the Services, such as your postings, we provide your information to other users of our Services.
- YOUR CALIFORNIA PRIVACY RIGHTS: If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to third-parties for their direct marketing purposes. VI. HOW LONG WE STORE YOUR PERSONAL INFORMATION
While your account is in existence, we retain your data as needed to provide you with and maintain the Services and for legitimate and essential business purposes such as making data-driven business decisions, complying with our legal obligations, and resolving disputes. Upon your request, we will delete or anonymize your data so that it no longer identifies you, unless, we are legally allowed or required to maintain certain personal data, including (without limitation); (i) if there is an unresolved issue relating to your accounts, such as an outstanding credit on your account or an unresolved claim or dispute we will retain the necessary personal data until the issue is resolved; (ii) where we are required for our legal, tax, audit, and accounting obligations; (iii) where necessary for our legitimate business interests such as fraud prevention or to maintain the security of our users.
VII. RETENTION OF YOUR INFORMATION
When we no longer need to retain your information, we will take reasonable steps to remove it from our systems and records and/or take steps to anonymize it so that you can no longer be identified from it. We retain your information for as long as we deem necessary for our legitimate business operations; provided, however, that your information is only retained to the extent permitted or required by applicable laws.
- Marketing opt out: You can update preferences to receive email or other communications by clicking unsubscribe on emails you receive from the Services. You may still receive communications from us for up to ten business days as we process your request. In addition, if at any time you wish not to receive any future marketing communications or you wish to have your name deleted from our mailing lists, please contact us at info@Petoodle.com. If you opt out of receiving marketing communications or other information we think may interest you, we can still send you emails about your account or any Services you have requested or received from us.
- ACCESSING AND UPDATING YOUR PERSONAL INFORMATION: You may access and update your registration information at any time by logging into your account on the Services. If you believe personal information, we maintain about you is inaccurate, you may request that we correct or amend the information by contacting us at info@petoodle.com with the subject line "Update Account Information" and your request in the body of your email. While we make efforts to accommodate requests to restrict our use of your information, we reserve the right to delete all or any portion of customer information if we are not able to reasonably accommodate a requested restriction.
VIII. LINKS TO OTHER WEBSITES
Our website may contain links to websites operated and maintained by third-parties, over which we have no control. Privacy policies on such linked websites may be different from our privacy policy. You access such linked websites at your own risk. You should always read the privacy policy of a linked website before disclosing any of your information on such website. We are not responsible for the actions of those other sites, the content of their sites, or any products or services they may offer.
IX. DATA PROTECTION
Unfortunately, the internet is not completely secure and despite our efforts to protect your personal information, we cannot guarantee the security of the data transmitted through our website. We use reasonable and appropriate security measures as required by applicable law. You also play a role in keeping your personal data safe and secure. It is important that when signing up for an online account be sure to choose an account password that would be difficult for others to guess and never reveal your password to anyone else. You are responsible for keeping this password confidential and for any use of your account. If you use a shared or public computer, never choose to have your login ID/email address or password remembered and make sure to log out of your account every time you leave the computer.
